A prefeitura de Rio Claro publicou no Diário Oficial desta quarta-feira (19), o Decreto Municipal nº 13.355, de 19 de junho de 2024, que desvincula, até 31 de dezembro de 2032, 30% das receitas municipais relativas a impostos, taxas e multas (já instituídos ou que vierem a ser criados até a referida data, seus adicionais e respectivos acréscimos legais, e outras receitas correntes). O montante auferido com a desvinculação poderá ser movimentado livremente pela prefeitura. O decreto é retroativo a 20 de dezembro de 2023, data de promulgação da emenda constitucional.
A autorização para desvinculação da receita tem como fundamento a Emenda Constitucional 132/2023, que institui a reforma tributária, e foi promulgada pelo Congresso Nacional em dezembro do ano passado. A emenda alterou o sistema tributário nacional trazendo mudanças significativas.
De acordo com o decreto municipal, ficam de fora da desvinculação os “recursos destinados ao financiamento das ações e serviços públicos de saúde e à manutenção e desenvolvimento do ensino, receitas de contribuições previdenciárias e de assistência à saúde dos servidores e transferências obrigatórias e voluntárias entre entes da federação, com destinação específica em lei”.
Os saldos financeiros anteriores à emenda constitucional permanecem vinculados. Por outro lado, o saldo financeiro com entrada posterior à emenda poderá ser desvinculado conforme as regras do decreto. Diante disso, o decreto estabelece que “caberá aos gestores dos fundos municipais realizarem a reprogramação das despesas considerando a desvinculação da receita, além de promover a consequente adequação no orçamento de cada exercício”.
